What is a specific performance?
Because every parcel of real estate is considered unique, courts may order specific performance — compelling a reluctant seller to go through with the sale — instead of just awarding money damages. It is a powerful remedy specific to real property.
The threat of specific performance is part of why a buyer’s equitable interest matters, and why recording notice of a contract can protect a buyer’s position while a dispute is resolved. Whether it is available depends on the facts and the law.
