A deed in which the seller guarantees clear, marketable title to the buyer.
What is a warranty deed?
A warranty deed transfers ownership and includes the seller’s guarantee that they hold good, marketable title free of undisclosed encumbrances — and a promise to defend that title. It gives a buyer the strongest protection of the common deed types.
Warranty deeds are the norm in ordinary property sales. They must be signed, acknowledged before a notary, and recorded to give constructive notice of the transfer.
