Marketable Title
Title free enough of defects and clouds that a reasonable buyer would accept it.
What is a marketable title?
Marketable title is ownership a buyer can accept without fear of litigation or hidden claims — free of undisclosed liens, competing interests, or clouds. Purchase contracts typically require the seller to deliver marketable title at closing.
A recorded memorandum of contract creates a temporary, intentional cloud that must be cleared before the seller can convey marketable title to anyone else — which is exactly why the prompt release matters once a deal ends.
Title companies determine marketability through a title search.
